What? 16 is young, but its not THAT young. Any 16 year old who thinks its okay to falsely accuse someone of rape isn't going to suddenly grow a better moral compass as they get older.

Everyone matures, but being 16 is no excuse for something that bad. By the time you're 16 you may not appreciate why, exactly, something is right or wrong--but you are absolutely old enough to know where your actions stand in the eyes of society.

As to maturity and her age. When I was fifteen I knew damn sure you couldnt walk around saying you were raped and send innocent people to prison. Heck, when I was 8 I knew you shouldnt do that. If we used her age as an excuse or that was common for someone that age wouldnt be many men of any age walking around free.

If this girl hadn't gotten caught telling him it was a lie he would have not only been a rapist but a child molestor in the eyes of the law. He would have had to go to all of his neighbors houses and tell them to their faces that he was a kiddy diddler.

If this was me in this situation and I was this fellow, if I knew she wasnt going to confess and get her just punishment and my name weren't going to be cleared...... there may be murder in my heart.

What should not be forgotten though, is that she has two children by now, placing their mom in prison for five years may just make them the criminals they wouldn't be otherwise. I agree that she should be punished but I'm unsure about the severity, a financial punishment and compensation for her victim seems the most constructive to me.
Can't make her work too much in prison because that would make the prison a socialist production facility that undermines the free market, especially if she is supposed to produce a profit of 1.5 million there.

In my opinion (and in my ideal world) she would do just that: five years in prison and a $1.5m fine. Retribution and flat-out punishment has its place in the criminal justice system.

I don't have a standard for lethal retribution - but if I did I would think that wishing someone dead, seriously, would be worse than sending someone to prison because as bad a callous misanthropy is lethal vindictiveness is worse.
