I've noticed that gunpowder units can be built in the High period even before gunpowder becomes available. This is because mercenaries only check what era they are available in as opposed to what technology events have happened. This means you see handgunners and bombards in the mercenary window, even though it's between 1205 and 1260, just because they are High/Late units.
I've thought about making a mod to eliminate the High portion from the final column of the unit_prod13.txt, the one that regulates if it can be a merc and when, but I've noticed a problem: The organ gun can be a merc in the High period, but the stats say it can be a merc only in the Late period, so I guess that idea is out.
The only other thing I can think about to prevent gunpowder units from being mercenaries in an era where they arent allowed is to not allow them to be mercenaries at all... but that would make the mercenary choices a little stale in the Late era.
