The assassin would probably kill the diplomat if he was nearby and the spy hide. I think you can take over them though, if you capture or bribe a settlement that they're in. Having diplomacy options would be strange as well: they'd have completely no authority as to who the faction is at war with.

They cant be seen. But, they are not totally invisible. U can still detect them.
U can use your assasin to assasinate enemy assasins.
U can use your diplomat to bribe other diplomat ... so why cant we bribe spies or assasins.

Btw, I'm playing RTW/BI. 1.5 Gold.

I think diplomacy is hardcoded so there's no way to mod that in to the game. I think the diplomacy system would be completely overhauled by now if it wasn't.
