I don't think that it really matters. Maybe a Graphic Art 101 kinda thing...
I'm going to say yes it was ripped off. So sue me.

Yep, that was kinda the (very obtuse) point of my post. Heck, you can go back to the 1920 and the Pep Boys (http://www.pepboys.com/about/pep_boys_story/story.html) Manny, Moe and Jack automotive supplies store for a similar "pose".
