Pathetic really. I bet more people will be aware of those "false and malicious" posts now than ever would have been without this lawsuit.

Hmm the question is whether they'd:
-Sue the poster
-Sue the moderator
-Sue the forum admin
-Sue the webhost

In a way, all of them are guilty of "allowing injurious statements", but I wonder why they sue the founder only.

Of course, it goes without saying that this is quite ridiculous, but I suppose from a legal perspective (and I'm no lawyer) this might actually go through as print media such as newspapers would be sued for posting such an article/allowing commentary to contain such material.

The ironic thing is that sueing the forum over bad publicity is stirring up a hell of a lot more than they could ever have bargained for ~:)

Someone in the official thread, however, mentioned that since the forum requires registration, but not validation, in some way the T&C (signing away responsibility for post content) might not be valid (I guess because they can't prove that a human hit OK?)

What's the legal standing of that, out of interest?

The interesting thing about this case to me is the fact that the forums serve as a semi-official discussion board for several major ISPs over here in Australia, at least one of which goes so far to have the CEO as a forum regular.

Now if they decide to offer financial support, this will get very funny, very quickly :grin2:

A company called Internode, for one, I can see supporting this as an excellent PR move :yes:

EDIT @FH - I guess they sue the founder only because he's the only one whose identity they have without getting IP warrants and the like :grin2:

After reading the Statement of Claim I have to say I don't understand this lawsuit.

None of the messages on that website were apparently out of order, and I mean any order whatsoever. Nearly all were relevant, many were clearly based in fact or in the poster's experience with that software. Which seems to be junk indeed. I had never heard of 2Clix before, but I will strongly advise against buying it should anyone in my circle consider that.

I was assuming that without reading anything further Adrian.
If a company has some trust in the quality of it's products, it wouldn't sue easily in case of negative comments. They probably need those 150.000$ to prevent going bankrupt.:laugh4:

I mean there are other companies which got bad feedback about their products which just changed their quality standards and/or actually listened to the complaints instead of just sueing anyone who disagrees.
