In fact, the guy still has a criminal record and the woman doesn't want to set it straight because she could lose the cash she stole from the education system.

Actually the way I see it putting it right would be to return the money and apologise to the guy publicly. Asking him to let bygones be bygones does not make it seem as though she's feeling sorry for her 'mistake'.

That's likely be quite a while longer than five years I think.

The problem with punishing this woman and saying she should be put in prison, is that it could act as a deterrent for other girls who have been raped to come forward. If a woman is raped and thinking about going to the police, reading about cases where a woman was charged with a false accusation and imprisoned could frighten them in to keeping quiet in fear, the rapist might even use such stories to try to ensure she doesn't come forward.

Some people will say that a genuine rape victim will have no risk of charges being brought against them, whether or not that is true, they are unlikely to be in a frame of mind to make such rational decisions at the time, a remote possibility could quite easily seem a certainty after such a traumatic experience.

Having said that, the idea of someone falsely accusing another of rape is something I find repulsive, it really does ruin the other person's life, purely out of spite. I would love to see such cases dealt with by malicious fake rape claims being given the same sentence the accused rapist would have received. Unfortunately, it's not that simple.

He didn't contest the charges - his lawyer should be going to gaol. The girl? Yes, she should be punished but I can see Frag's point, once the wheels start moving she would find herself rapidly in a situation where she would be behind bars if she admitted the truth.

Personally - I am hardly surprised, the only reason this came to light is that she felt enough remorse to want to apolagise. The fact that she appears to have no idea what she did to this guy, I just don't know what to think about that.

She admits he didn't do it, would you be angry at someone who wronged you at the age of sixteen. I almost killed somoene when I was sixteen I stabbed him in the gut. No idea why, I just did it. I am not that person anymore, and she probably isn't either.

Reformation and forgiveness are beautiful concepts but not always applicable. IMO 16 is old enough to know that you might be ruining a person's life. And it's not exactly a matter of simple wrong doing is it?
I mean I get your point but the guy in question spent five years in prison.....that's far more than what can be tolerated as a mistake made by a child.
Also I don't think that the 1.5 mill of state's money is the main issue. The issue is that a person was wrongly convicted.

Anyway I do not think that anything will happen to the girl unless, the man, presses the charges (that is the correct phrase I hope....?). If he really thinks that he can forgive her then it'll be commendable on his part.

There's also the idea of women putting rape charges because they were dumped, never called again, felt ashamed in the morning, wanted money or publicity etc...

Man accused of rape end up in prison and have a stain for the rest of their lives, it's not a small matter. It needs to be shown that you can't be kidding with rape charges...

I have seen both sides of this (not personally, thank goodness). I've known women who were violated, and I saw a guy get destroyed by a false accusation of rape. I don't see any easy answers.

The one does not exclude the other. That there isn't enough proof to convict a suspect of a crime doesn't mean that there is suddenly enough proof to convict the victim of making a false accusation.

Prosecuting the woman in the OP would, at worst, give false accusers a clue that it isn't a good idea to admit you've been lying - especially to the person you've sent to jail. I doubt that genuine rape victims would feel discouraged to report to the police. I say charge the idiot and send her to jail.

I found it really sad when they said "You are a big black guy, you are guilty". Damn bigots.

I'd like to agree with you, but what if the lawyer was right? If he'd fought the charges and been convicted anyway, he'd probably still be in prison today--hardly an improvement on his current situation. The girl's actions are despicable, and the lawyer's advice may have been horrible, but I think our legal system and our culture that tacitly assumes the guilt of anyone charged with a crime is just as culpable. Innocent until proven guilty needs to be more than just a nice saying, and the falsely accused need to feel confident that justice will be on their side.

His original lawyer saying that the jury will be thinking that as soon as they lay their eyes on him.

The lawyer interviewed said that 95% of cases are resolved by plea bargain.

Send her to jail. Make her pay back a decent sum of the money/portion of her income goes towards him in the future.

What she did back then was wrong, but she came clear, that's commendable it obviously bothered her. I would be angry at the system not at a then 16 year old girl. This I agree with. If her apology was heartfelt then perhaps a magnanimous man would let it go. It would also be the good thing to do.

EDIT: Certain issues get me angry regardless of the state I'm in. I also wonder whether he gets some official papers that prove he was wrongfully imprisoned. Because he certainly should.

And then she should receive whatever punishment there is for false testament as a teenager. Completely ruining her life is useless because then she can never work to pay back the money.

Even if he forgives her, the state should be responsible and get the money back - the money they got from tax payers or financial aid or someone. Give this money to the people who deserve it. This is a huge amount of money we're talking about. Letting her keep that huge amount of money will encourage others and there'll be more victims. We all know that this happens to a lot of people. More frauds like this need to be prevented so that innocent lives don't get ruined and the tax payers' money don't get wasted. The system has been played around with and this can hurt the system's judgement in helping the real rape victims.

im sorry but even a 16 year old knows very well that what she did was wrong. even though she does perhaps not clearly oversee all consequenses (amongst them the fact that she would feel incredibly guilty) but that doesnt mean she is totally has no idea of right and wrong. and if she didnt have any such sense when 16 what makes you think she would have when 18 or 20 or 22?

What would you want from her if it would have been you. Nothing to gain here in any way, letting it rest is just better. Forgive her for being incredibly stupid and let her have the life she has now. Sometimes you lose that's just how things go sometimes

im not looking at this from a personal perspective. i dont even know if i can. i would not be the same person as i am now so i cant say if i would be bitter or if i would not be.

when do you determine that its better to let things go? i mean if she stole a pair of shoes i would be inclined to agree, if she murdered someone i would not be. this seems to be right on the edge.

but thats the personal perspective, there is also the perspective of the law and justice should always triumph. i dont think it would be just to let her walk. at least the money should be repayed. i do agree that giving her a prison sentence might be rather harsh in this case and would not really benefit anyone. but simple forgiveness doesnt send the right message either. we have these penalty to serve as warnings and if we are not consistent we would do better not to have laws at all.

She was 16 at the time, can't really hold her responsible. There's the difference. What could have happened, as it happens a lot,is that she panicked after sleeping with him and once the gears got going there was no turning back. What she did was wrong but the system is worse. I think she deserves a little compassion instead of scrutiny

Not if you're raised badly - at 16 you aren't an independant thinker, you are unlikely to have much experience of life outside your family or peer group. As such, you may not know that something like pergury is, or understand the consequences.

And, she was a minor when the offence was committed - I appreciate that she should have confessed sooner but she can't have been continuously committing a crime by not confessing, that doesn't really work.

Just Retribution would be five years in gaol and a 1.5m fine - but that is unlikely to serve society.

So, what to do?

Have her sell off anything she bought with the 1.5 million and maker her give the money plus the what's left of the 1.5m to her victim.

Then stick her on the sex offender registry for a year to see how she likes it.

put her in a government institution where she will get food and clothing and where she will work to serve society until she has paid back her debt to "society/government/victim".

What should not be forgotten though, is that she has two children by now, placing their mom in prison for five years may just make them the criminals they wouldn't be otherwise. I agree that she should be punished but I'm unsure about the severity, a financial punishment and compensation for her victim seems the most constructive to me.
Can't make her work too much in prison because that would make the prison a socialist production facility that undermines the free market, especially if she is supposed to produce a profit of 1.5 million there.

What if she bought drugs, alcohol and parties for the money (which she most likely did)? Can't sell that anymore.

Suppose that the girl testified in court that this guy killed someone who is missing, and he would have gotten the death penalty. What would the girl deserve if later admits she lied?

Saying that does not take someone freedom away for X amount of time and then callously blow off their suffering, which means you have a far lower standard for lethal retribution than do I.

I don't have a standard for lethal retribution - but if I did I would think that wishing someone dead, seriously, would be worse than sending someone to prison because as bad a callous misanthropy is lethal vindictiveness is worse.
