I have a general who has the 'night fighter' trait, but how do you fight a night battle then, i don't see any pop-up which asks me if i want to fight a night battle. Can you choose to fight a night battle or is it just random?

You can fight night battles, when you attack (attack not defend) against another army the scroll will have an tick box that allows the battle to be fought at night, that way enemy reinforcement that isn't led by an night fighter general won't be participating in the battle. This is particularly useful against Hordes from the Stepps.
I think you can only fight night battles in BI.
I don't seem to get that tick box, can you perhaps take a screenshot of the tick box for me? maybe i can find a solution then. I have BI

When the tile comes up showing what your army is as well as giving the option of fight on battle map or autoresolve and what the opposing army is, you will see a toggle at the bottom of the screen, I believe that it's on the bottom right. I am in a RTW campaign (not BI) and have not had the option of a night battle in some time.
If you can fight a night battle, you will see that the box to check is open and "checkable." If you cannot fight a night battle, the box will not be there or it will be "grayed out."
If the box is checkable and you want to fight a night battle, check the box. Checking the box back and forth you will see the picture on the tile change from daytime to nighttime images.

RTW version 1.5 can do night battles also. I turned them on for the RTW version of Amazon:Total War (which that screenshot is from). You have to import a lot of files from BI to do it however. Dimebag has an article on how to do it here.
I prefer it without the torches, as they slow my machine to a crawl. I just like how it looks better too.
