In your example, by not having disabled access in your store you are denying those people access to the services or goods you provide. It's a question of access, and different from this case. The complaint against eharmony was never about gay people not being able to access the service, but that the services provided didn't extend as much as the gay complainant wanted. It'd be like a person in a wheelchair suing a moped/scooter store for not selling mobile electric wheelchairs.
