    Default Spartacus: Blood&Sand stealing music from EB?

    Good day fellow EB-fans!
    Those of you who followed Starz' Spartacus series might have noticed that they are not ashamed of being "inspired" by other previous works such as ROME or 300, also when it comes to the music. But right now I watched the 9th episode and from 34:50 on, the backround music - pan(?) flute - sounds a LOT like TPCs music. I think its SusianFieldsSugar.
    Even in one episode before I thought I heard some EB music but I wasn't sure.
    Maybe I am confusing some stuff here but I wonder what you guys think...

    maybe they just share some free music sources? anyway, did the EB team made a trade rights or patent on their music?
    and if that was... maybe we can think that they have eaten some pizza now...

    I checked, you really must play less EB! I could barely hear it. It does bear some resemblance...

    All you agree is that you read more history Recruitment Viewer or Unit documentation has some rules however.

    so? maybe we should think positive first, the Spartacus :Blood and Sand producers are allready contacting the EB teams, giving them one truck full of pizza, and get some agreement on this matter first...

    Since when is music an invention that can be exploited?

    You've got copy rights on every original work you make, whether it be a song or your notes in class.

    Given how these series are produced, I highly doubt that they would steal music from obscure (to them) internet sources. They don't seem to be working on a shoe-string budget, so no doubt they have a reasonably well-known composer working for them. It is of course possible that said composer took inspiration from EB, or more likely that he and TPC took their inspiration from the same sources. I doubt he'd be stupid enough to steal it, though. Even if copyright wasn't registered (which is not necessary anymore for establishing copyright), the possession of draft versions and similar already goes a long way to proving original ownership. Not to mention that such court cases are bad for the finances and reputations of everyone involved.

    TPC had access to music databases, ie sound libraries/databases of various instruments and such. He owned some pretty nifty music making software and no, its not Dance Ejay or such.
    It seems said databases are widely used, as when he tried to make a Lusitanian music piece he used the "declare war horn sound" from Civilization IV without knowing it (TPC swears by CivIII)

    Perhaps the EB team could sue Starz for slander?

    1. It is slander to make a claim of similarity between Spartacus Blood and Sand, and any program, game, documentary, drama, or mod that has any research, historical accuracy, or quality in it.

    2. It implied members of the Europa Barbarorum team are involved with the making of a brainless ahistorical series that makes even 300 seem like Shakespear, another falsehood.

    I'm not serious about slander lawsuits, there are too many of those, but I would make myself scarce if anyone suggested I had anything to do with Spartacus trash and more trash.

    Well, if you didn't made any proper step in order to protect your work anyone can take it as their own, almost as a public property. it's your duty to protect carefully your work, otherwise, expect it to be stolen...

    Not completely true. In the USA, it used to be that you had to register your work in order to gain copyright. This part was dispensed with in the eighties, but because registration is still possible many people believe it is mandatory. Registration does help in court cases, but you are not unprotected without it. Similarly posting a copyright-notice ("Copyright 2010 by Ludens") is not required either, but strengthens the protection. In other words: unless it is stated explicitly that an original work is in the public domain, the creator can claim copyright. This applies even to things as trivial as e-mails or websites (but don't try to make a court case out of that: unless you can prove actual damages, the judge is going to laugh you out of court).

    IIRC it is true that you lose your copyright if you know it is being violated but do not take action to protect it (cfr. Marion Zimmer Bradley), but I am not a lawyer so don't take my word for this. Check out this website for more information on the myths about copyright.
