The law is more reactive than proactive. It serves as a means for people to take legal action for being discriminated based on something like race, sex or age.

does it get abused? Of course, and it is usually at larger companies who try to meet quotas for things like management, Wal-Mart is a good example. It is not rampant, but it does exist when a certain "role" needs to be fulfilled.

And for the record, Asians rarely get included as minorities in both EOE and college quotas even though, by definition, they are minorities. This in and of itself shows that the law is far from perfect.
