In custom battle it is possible to do your own set up with regards to your defending army. If you choose to play as the attacking force your options are limited to a number of pre-defined formations. Why this limitation ? Why not granting this same freedom to the attacking force. For the best of me I can not think of a simple reason.
Apart from the fact that I think it's a basic limitation in this game I was once again reminded of this when I'd created a battle map with an odd phenomenon.
I had at the top of my map (north) created a river running from west to east automatically resulting in having the attacking force appear to the north of the river. Playing as the attacker I found that I was all of a sudden able to completely rearange my forces (as if I was defending) prior to hitting the attack button. Why this was....escapes me. Is this a 'work around' of the attack limitation ?

    Anyone has any Ideas ?

For me the fact that I can't place my army wherever I want when I attack (that is before pushing begin battle button) is no limitation. I think it's pretty reasonable, as I don't really know where exactly the defenders will take position. Even when I defend I don't always arrange my army - I do it only after a battle starts.

I think that this is a bit of limitation-more like unfair. As defender you have the chance of arranging your army without the cost of your men get tired, but as attacker, after you arrange your formation, usually you have to march through almost all the battlefield...

This is a natural disadvantage of any attacker, I think it makes sense.
