I agree with Viking, because after destorying a number of Eagles I only got an eagle taker trait for one of my general last night.
But one think to take note is that, that general is a warlord that i build from my city so i was thinking whether or not they are the only ones that can get the trait?

Maybe some of the dead Legionaries "healed", thus not eliminating the unit.
I have never captured an eagle in RTW, I always knock the Romans out before they get them.

I've only captured Eagles in BI and when I got the acknowledgement it said that the eagle was taken to a nearby city I owned and the Romans would make great efforts to get it back.
Recently I took down 3 1st Cohorts in one battle but nothing was said (I couldn't believe it). This time I wasn't near any city I owned so could this be a factor? Does there need to be a place for the eagle to go? Has anyone else noticed this or is it just an odd coincidence?

I've had the eagle capture message in BI a couple of times playing as ERE, but not had any eagle related traits.
One thing - if you are are currently in a horde, you do not have a city to return the captured eagle to - could this be why some folks aren't seeing this after wiping out cohorts?

I was not in horde. I captured the eagle as the Franks when the WRE sallied from a siege. The eagle was not in the sallying army, but in a reinforcing army that came from outside. Actually, I think the sallying army was the supporting one.

Good question actually. According to his traits and retinues he should only have have 2 loyalty points, so he must be loyal by personality.

If you're besieging a city that has a first cohort in it and you hit the auto-combat button, your general doesn't get credit for capturing the eagle, even though there's nowhere for the 1st cohort to retreat to. Maybe they have time to see you coming and melt the eagle down or something.
My Frankish general captured 4 eagles, gaining the attribute "Eagle Collector" and getting the title "...of the Eagles."
Another thought: in all my battles where my general got credit for capturing an eagle, the general's bodyguard was heavily engaged in the action. Perhaps your general needs to take a more active role in the combat for it to count as a capture.
