Well of course the low-loyalty son would be in command if he had more command stars than his brother; but since you already know that, I'm assuming that they have equal numbers of stars, correct? If so, then he would be general if he was the last unit you placed in that particular stack.

Otherwise, he might have been the stack commander simply by virtue of being the older brother. Do you remember which son was the older of the two?
