Early vs Late Bodyguards

Forgive me if this has been asked before, but what affects which type of bodyguard is applied to a family member or general? And more importantly how can it be controlled?

You need the Marian Reforms to have those late Bodyguards.

Woops, forgot about that, sorry. I think those are the only two requirements, though.

You only need the imperial palace indirectly. You need an imperial palace to trigger the marian reforms

Yep, but the Marian Reforms must be triggered even for the non-Roman factions to get their late bodyguards.
