Testing the extend of free speech is what the ACLU does. This is perfectly reasonable behaviour from the point of ACLU. They're not concerned with the content of those whose freedom they protect.

Personally, I would blow Fred's brains out if he showed up at a funeral of one of my beloved.

Just shows that if you're extremist and offensive, the ACLU will probably support you. Now if you're a HS student who makes the mistake of trying to thank God in your graduation speech (tried because mic was cut), dont expect any help- they'll side with the school. :wink:

Important questions for the consitutionality issue:
Is free speech being repressed?
They are not being censored - the state is merely limiting where they can say it.
Are they discriminating in which groups are affected by this?
No, this affects all picketers and protesters equal, no matter their message.
So, then, does restricting people from protesting at a certain location and time violate the constitution?
I do not think so. Precedence would seem to uphold this law. See the 'free speech zone' at the democratic national convention '04.

Fundamentally, their right to free speech is not being taken away. They can protest at cemetaries, just not a certain times. They can protest in the same town at the same time of the funeral.

I would be tempted towards violence if they showed up at the funeral of someone I knew.

PS. I wished the ACLU defended the whole bill of rights with equal vigor. But I guess NAMBLA takes up a lot of their time.

Personally, I feel limitng where speech can be said is violating free speech, but its one I've come to accept along with others.

This is where idling gets us. For what, 8 or 9 years now, this guy has been terrorizing American families mourning their deceased, but no one paid attention when it was just dead gay people. Pretty fekking shallow, can't stick up for them, right?

The ACLU is at least consistent in testing the limits of free speech by picking people who are either seriously being censored OR people spouting highly unpopular views. They don't really go after every nickel and dime case of prayer at the graduation or people being thrown off the bus for wearing a t-shirt that shows Bsuh sodomizing tony Blair.

As much as you guys hate to admit it, we need organizations like the ACLU, just like we need organizations like the NRA and the SPJ.

I've made my opinion of Phelps clear in other threads. His cronies show up at a funeral I'm attending their brains will be getting scraped off the pavementand theres not a jury in the country that will convict me. There are some things you don't do in America, and disrupting funerals with hateful, scathing, obscene signs is at the top of the list.

Putting these people into a "free speech zone" and limitng where they can say it is something I advocate, but hey, maybe it is unconstitutional. It doens't help this church does suprise attacks on ceremonies. I wish all of those people horrible, horrible fates.
