Default Anyone Here Live in Miami, FL?

IIRC, there are 2 or 3 guys here living in Miami. If you do, I have a proposition for you. Please PM me. Sorry, Moderators, for using up a topic space for this; it's for a good cause, I promise.

Sure. I know some guys who can take care of it. They have a dock where the boat can moor. They're real pro's, they'll take care of your stuff until you are ready to distribute it. No sweat.

I know you are good for it, but we want the cash up front.

    Simply brilliant Gregoshi.

Though clearly Kukri wants to take advantage of all the stiff frozen lizards that are falling out of trees in Florida thanks to the cold snap.

As usual, you guys are side-bustingly hilarious ("Mail-enhancement... OMG! )

It's much more mundane: I'm suing Alienware Corp (based in Miami) for losing and not replacing my son's $3,000 laptop, in Dade County Small Claims Court. Hoping to save plane fare, I need someone there to appear in court at the hearing, on my behalf with a Power of Attorney - hoping Alienware doesn't even show up, and I get a Judgment against them. Be my paid agent, in effect.

I thought Dell bought them. Or are they still separate for legal reasons?

Wow, that was much less devious than I thought it would be.

The fact that you trust a person online you most likely have never met in person to appear for you in court really shows the kind of great relationship and community members of this forum experience!

Well, I have associates in Florida with Spectrum Investigations who mediate in court like I do, but they charge quite a lot per hour and it probably would not be worth it to pay someone to go represent you for a 3k claim, unless you have the defendant pick up the tab.

Isn't the first rule of US law to never represent yourself in court?

Why aren't you doing this in your home state?

    IANAL. I repeat, IANAL.

You could possibly argue that the 'transaction' occurred based on where you live, not based on where the physical company is. State laws vary, but I almost sued DHL for 'losing' a rather expensive bluetooth headset for my old phone that I left when dropping off a package last year. NC law requires that I sue in the county where the business lists it's state HQ at if it has a physical presence. Or something along those lines. Read up on this more, and maybe spend a few bucks to get an hour of a local attorney's time. If it's doable, $100 or so thrown at some solid legal advice could go a long way to getting you a favorable judgment. Best of luck.

Small claims is different. It's purposefully designed to permit 'the average folk' to litigate without the absolute need for very expensive legal counsel. As such, the legal clerks and staff tend to be more forgiving and helpful, and the actual legal proceedings supposedly a bit easier to understand as the judge orchestrates it all. IIRC the usual dollar value limit one can seek in damages cannot exceed $5000 USD.

Am I just really, really immature, or did anyone else bust out laughing at a certain point while reading the above quote?
