Having hosted the game in question and receiving Spartan's explanation from him as it was happening instead of 3+years later, I think I'm in a good position to arbitrate here.

Now, straight from the Mafia III commentary, a PM from Spartan himself:

this will either one, mess up the mafia, or two confuse the villagers. i hope the mafia mess up.

Despite the fact that he had been around the other two Mafia games where it was clear that the two mafiosi knew each other from the outset. I find ATPG's argument to be highly unlikely.

Therefore, I can only conclude that because his argument regarding "pulling a Spartan" is wrong, he is guilty.

Tie vote, so the kung fu master decided that it would come down to a duel between the two. Chaotix protested, saying that pizza clearly had a death wish and should be the one to go. Pizza took the oppurtunity to knock him out.

atheotes was playing with his terracotta figures when a man came into the room.
“Can I join in?” the man inquired.
“No, these are limited edition figures!” atheotes eyes not moving to see the man.
“So why only play alone? Let me join in.” The man suggested.
“No! You can’t touch this!” atheotes spun around to the man, to see him raise his hammer for a downwards swing.
“STOP!!” atheotes screams
“Hammer Time!” the man’s hammer went crashing downwards on the figures, smashing them to pieces.
“NOOOOOOOOOOOOOOO” atheotes’ tears flood down his face.
The man spun the hammer around and caught atheotes under his chin, causing him to fly across the room. He picked up atheotes’ head and paints a circle in red on his forehead.

Shlin was on the roof. “If anyone comes after me here, I’ll get them for sure!”

Hours passed, until a geisha came and stood next to him, looking out towards the fields. Shlin felt a large lump in his throat; this is the closest he has ever come to a female since his birth and brought to the temple to be raised as an orphan.

“Well... I like how the moist air gives a glow on the fields” Shlin said nervously. The Geisha gave a little-giggle, a fan in front of her mouth. Shlin’s palms were getting really sweaty, his hair slightly damp, his mouth becoming dry. What is this feeling?

“Would you like to see what is under my robe?” the Geisha asked, eyes still fixed on the fields, the voice lacking in any emotion. This comment completely catches Shlin off-guard, he was unable to speak!

The Geisha turns around to him, Shlin’s feet felt frozen in place as the Geisha begins to open her robe, unconsciously as he stared, he licked his lips. Before he even got to see anything, a venomous frog jumps on his face. Shlin screams as he starts to collapse.

He awakes later in the infirmary, with a little red mark on his forehead.
