I wondered that too or what if there not both FM's like b4 i was commanding the 1st Lydian I was in the siege of Halikarnassos with Chaotix before he had to take his leave from the game. I didnt recieve points so I imagine only the person actually fighting it gets the points, which really only makes sense because that person makes the actual tactical decisions to gain said victory. Because that way if he loses then the other person wouldnt be "punished"(penalized bp points) to. But im just assuming thats how things work out.

yes, in my opinion this would make sense too. i just wanted to make it clear.
so in that case, to gain battle points, you must have an own army...

No, you don't. Keep in mind that the commanders of each regular army (Lydian, Syrian etc.) don't own their armies - they're just allowed to command them by the Basileus, the real owner. The only ones who own their own armies are satraps, the Kleronomos Basileios and the Basileus himself.
What you need to do to gain battlepoints is to command an army in battle and gain at least a close victory (which gives you ½). If you're just tagging along in an army and the appointed commander can't command for whatever reason, and you do it in his stead, that counts as well.
